What the file has to contain
These are the documents the authorities expect for the lead route. This is a reference list, not an eligibility check: whether any one item is met depends on your own situation. Items marked for apostille must be legalized before they will be accepted.
Form I-129 must be filed by a US employer, a US agent, or a foreign employer through a US agent. A founder's own US company or a designated US agent can serve as petitioner.
Either a single major internationally-recognized award, or at least 3 of the 8 regulatory criteria (awards, association memberships, press about you, judging, major original contributions, scholarly authorship, critical role at distinguished orgs, high remuneration).
A written advisory opinion from a peer group, labor organization, or management organization in the field (or evidence one is not available) generally must accompany the petition.
Copy of any written contract, or a summary of the oral agreement, plus an explanation of the events/activities and dates.

The United States is a party to the 1961 Hague Apostille Convention (in force for the US since 1981). US-issued public documents used abroad get an apostille from the relevant state Secretary of State or the US Dept of State Authentications Office. NOTE: for INBOUND US visas this rarely matters, US immigration does not require apostilles on foreign documents; consular officers accept originals + certified translations. Foreign police/civil docs are generally submitted as-is, not apostilled.
